Why Is Subway Being Sued
The huge franchise has been hitting back after Karen Dhanowa and Nilima Amin, both of Alameda County, California, filed a multi-million-dollar lawsuit.
Their court papers allege: Independent testing has repeatedly affirmed the products are made from anything but tuna.
Subway strenuously denies the alleged lack of tuna.
But the women claim in their legal challenge that the fish sandwich is made from a mixture of various concoctions that do not constitute tuna, yet have been blended together by defendants to imitate the appearance of tuna”.
Their filing alleges this has been done as a money-saving exercise, to increase profits at the expense of unsuspecting buyers who have shelled out $4.25 for one of the six-inch tuna subs.
Their attorney, Shalini Dogra, told The Washington Post: that the ingedients may not even include fish.
Dhanowa and Amin have brought claims of fraud, intentional misrepresentation, negligent misrepresentation, and unjust enrichment against the company.
They want to have their claim certified as a class action, which would allow thousands of other potentially dissatisfied customers to join in the legal action.

Thatâs what the lawsuit alleges. In the pursuit of the truth, the New York Times sent Subwayâs tuna to a commercial food testing lab. The results? âNo amplifiableâ tuna DNA.
But the story remains as murky as the mayo holding the tuna fish together. Karen James, a molecular ecologist at the University of Maine, tells Inverse the lack of tuna DNA isnât necessarily something tuna fish-lovers should stress about. It may, however, point toward even more worrying issues, including unsustainable fishing practices and seafood mislabeling.
James wrote a popular thread on Twitter expanding on the shortcomings of this analysis after she read about it in the Times.
